Terms of Service

1. Acceptance of Terms

By creating an account or using Supercharge Growth ("the Service", "platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free trial users and paid subscribers.

2. Description of Service

Supercharge Growth is an AI-powered ad creative generation platform designed for Health & Wellness DTC brands. The platform allows users to generate static ad creatives using their brand assets, product images, and creative briefs. Output includes AI-generated copy, AI-generated backgrounds, and production-ready PNG exports.

3. Accounts and Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your organization. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account.

4. Coins, Subscriptions, and Billing

The platform operates on a coin-based credit system. Subscriptions are billed monthly. Coins reset at the start of each billing cycle and do not roll over. Additional coin packs may be purchased at any time. All payments are non-refundable unless required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is false, misleading, defamatory, or violates applicable advertising regulations.
• Upload content that infringes third-party intellectual property rights, including trademarks or copyrights.
• Generate content that is discriminatory, hateful, or promotes illegal activity.
• Attempt to reverse-engineer, scrape, or extract proprietary models or data from the platform.
• Use automated scripts or bots to abuse the generation system or exhaust coin allocations fraudulently.
• Resell or redistribute access to the platform without written authorization.

6. Intellectual Property

Your assets: You retain full ownership of all brand assets, product images, and briefs you upload. You grant us a limited, non-exclusive license to process these assets solely to provide the Service.

Generated creatives: You own the output creatives generated from your inputs, subject to any restrictions imposed by underlying AI providers. We make no claim to ownership of your generated creatives.

Platform: All platform code, templates, scoring systems, and infrastructure are the exclusive property of Supercharge Growth.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind. We do not guarantee that generated creatives will achieve any specific advertising performance, ROAS, or conversion rate. Performance scores are indicative benchmarks only and do not constitute a guarantee of results.

8. Limitation of Liability

To the maximum extent permitted by law, Supercharge Growth shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability for any claims arising under these terms shall not exceed the amount you paid us in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account if you breach these terms, engage in fraudulent activity, or use the platform in a manner that harms other users or the platform. You may terminate your account at any time by contacting support@superchargegrowth.com.

10. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

11. Changes to Terms

We may update these Terms of Service at any time. We will provide at least 14 days' notice of material changes via email or in-platform notification. Continued use of the Service after the effective date constitutes acceptance of the revised terms.
